Statuts urbains et codes réglementent ce droit. Des conditions sont fixées à la mise en gage de certains objets : immeuble ou meuble, statut de l’objet, propriété reconnue du débiteur ou objet volé, ou braconné. Le droit de mettre des bestiaux en gage est réglementé (&#039;&#039;Essendes hab&#039;&#039;, &#039;&#039;Fahrende hab&#039;&#039;, v. [[Fahrende Hab|Fahrende hab]]). De même, la valeur déclarée du gage fait également l’objet d’une réglementation : en cas de doute, on fait appel au Magistrat. Celui-ci tient un registre ou livre des gages (v. [[Pfandbuch|Livre des gages, Pfandbuch]]).&lt;br&gt;<br /> <br /> Le terme de l’engagement est également fixé, avec en cas de défaut, la saisie du gage et sa mise en vente forcée (v. [[&#039;&#039;Gant&#039;&#039;]], [[Mont-de-Piété|Mont-de-Piété-&#039;&#039;Leihhaus&#039;&#039;-&#039;&#039;Pfandhaus&#039;&#039;]]), ou la prise d’otage du débiteur, et la saisie des biens destinés à rembourser pour acquittement ou libération (v. Les délinquants et condamnés doivent également livrer un gage en attente du paiement de l’amende.&lt;br&gt;<br /> <br /> Mise en gage d’une principauté, une seigneurie, un bailliage, une ville ou encore le droit de lever une ou plusieurs taxes ou impôts. Le recours à la mise en gage de seigneuries, territoires, grands domaines a été un moyen de gestion publique (&#039;&#039;Pfandherrschaft&#039;&#039;), pratiqué tout particulièrement par les Habsbourg. Il a aussi été pratiqué couramment en Alsace (v. [[Engagement]], [[Engagiste]]). Les &#039;&#039;Pfandherren&#039;&#039; sont les créanciers, parfois associés en un syndicat de créanciers, qui, en échange d’un prêt ou du remboursement d’un emprunt, réclament l’engagement d’une fonction – ainsi celle de prévôt (&#039;&#039;Schultheissenamt&#039;&#039;) avec la collecte de ses revenus fiscaux et le contrôle des finances d’une collectivité.
